US Court Mandates Freedom of Abrego Garcia from Immigration Custody
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without lawful basis.
"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her order.
The case originates in a erroneous removal to El Salvador in March, which the government later acknowledged was an error. Following his repatriation to the United States to answer human smuggling charges, he was held in immigration detention.
In her order, the court noted that the government lacks a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
Background of the Legal Challenge
The legal challenge center on disputed assertions. While the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically denies this allegation.
He has also entered a not guilty plea to the conspiracy charges, which are part of a ongoing trial in the state of Tennessee.
Conditions of Freedom
The judge, who was overseeing his petition to removal in a federal court, determined that he must now adhere to the terms of his release from custody in Tennessee. This decision shifts his supervision to the Tennessee court.
This ruling marks a significant development in a complex legal battle involving claims of mistaken imprisonment and contested gang affiliations.
